Terms of Sale. The display of goods on this website does not constitute an offer to sell them as described, or to sell any goods at all. By clicking to place an order, you are making an offer to buy which incorporates these terms. If Budwig Center or Budwig Care S.L (hereafter called Budwig) elect to accept your offer, you will receive an order confirmation. Budwig reserves the right to decline any order, without giving a reason.
Orders. Orders are only binding when the order confirmation is received. You should check the order confirmation and notify Budwig of any mistake by email immediately, otherwise the details stated in the order confirmation will apply to the Contract.
Budwig must receive payment of the whole of the price for the goods that you order before your order can be accepted. Once payment has been received by Budwig, we will confirm that your order has been accepted by sending an e-mail to you at the e-mail address you provide in your order form. Our acceptance of your order brings into existence a legally binding contract between us. In connection with your order Budwig will email the confirmation as above, a notice of shipping when your goods are dispatched and a “Thank You” for your order after delivery. Budwig will not send any further emails relating to our products, offers or services unless you ask us to by signing up to our newsletter service.
Only adults (that is, those aged 18 and over) are entitled to enter into legally binding contracts and as a result are the only people entitled to transact through this site. Any other individuals who are unable to perform legally binding contracts are prohibited from ordering goods using this site. If you do not qualify DO NOT use this site. By ordering on this website you are making a statement, upon which we are entitled to rely, that you are aged 18 years or older and capable of forming a legally binding contract
Prices: The prices payable for goods that you order are as set out in our website. All of our charges are in Euros and you will be billed in Euro currency. Please note if you are paying by credit card that any that any currency fluctuations and credit card charges may make a difference to the amount billed on your credit card. Budwig does not raise a separate credit card transaction charge.
You may be required to pay extra for transport, and it might not be possible for Budwig to deliver to some countries. Our delivery charges are set out in our website.
Cancellation: You may cancel your contract with us for the goods you order within 24 hours of placing the order and to cancel your contract you must notify Budwig by e-mail to our e-mail address ([email protected])
Returns, Refunds, Claims or Legal Action: Most of the products offered on www.BudwigCenter.com are specialty supplements and therefore we cannot accept any refunds, due to custom regulations of products entering Europe from the USA or Canada. Therefore, all sales are final after 24 hours of placing your order. Patients who receive treatment at the Budwig Center or through our Home Care programs, will be required to sign an agreement beforehand or make a deposit which becomes a binding contract. Once a deposit is made and/or the clinic/patient agreement is signed there are no refunds for any time, supplements, treatments, etc., that are not used by the patient due to their decision to stop the program, for whatever reason, before the agreed period of treatment time has expired. All patients understand that if at any time they feel uncomfortable or do not wish to have any particular treatments or remedies they are receiving or being offered at the Budwig Center; they are required to immediately inform the therapist that they do not wish to receive any of that treatment or remedy. No claims or refunds or legal action can be taken against the therapist or Budwig Center afterwards if no objection was made at the time of the treatment or when the remedy was issued.
Cancellation by Budwig – We reserve the right to cancel the contract between us if we have insufficient stock to deliver the goods you have ordered, or the product is no longer available, or Budwig cannot deliver to your area or country. If Budwig does cancel your contract, Budwig will notify you by e-mail and will re-credit to your account any sum deducted by us from your credit card as soon as possible but in any event within 30 days of your order. Budwig will not be obliged to offer any additional compensation for disappointment suffered.
Delivery of Goods: Budwig will deliver the goods ordered by you to the address you give us for delivery at the time you make your order. It is your responsibility to ensure that the delivery address you give us is correct and accurate. Delivery will be made as soon as possible after your order is accepted and in any event within 30 days of your order. You will become the owner of the goods you have ordered when they have been dispatched to you. Once goods have been delivered to you, they will be held at your own risk and we will not be liable for their loss or destruction. If your order is returned to us because the courier or postal service could not complete the delivery to you for whatever reason we cannot be held responsible and will probably be refused or held by customs
Liability– If the goods we deliver are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, Budwig shall have no liability to you unless you notify us by e-mail of the problem within 7 working days of the delivery of the goods in question. If you do not receive goods ordered by you within 30 days of the date on which you ordered them, Budwig shall have no liability to you unless you notify us by e-mail at our contact address of the problem within 30 days of the date on which you ordered the goods. If you notify a problem to Budwig under this condition, our only obligation will be, at your option: to make good any shortage or non-delivery, or to replace any goods that are damaged or defective; or refund to you the amount paid by you for the goods in question in whatever way Budwig will choose.
If the goods have been lost by the transport company, you have the obligation to claim from the transport company and you become the owner of the goods once they have been dispatched to you.
Custom Fees: You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our site. The importation or exportation of certain of our goods to you may be prohibited by certain national laws. Budwig makes no representation and accept no liability in respect of the export or import of the goods you purchase.
Notices: Unless otherwise expressly stated in these terms and conditions, all notices from you to us must be in writing and sent by e-mail to our contact address at: [email protected] and all notices from us to you will be displayed on our website from to time.
Events Beyond Our Control: Budwig shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond our control including, without limitation, strikes, lockouts and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.
Invalidity: If any part of these terms and conditions is unenforceable (including any provision in which we exclude or liability to you) the enforceability of any other part of these conditions will not be affected.
Privacy:You acknowledge and agree to be bound by the terms of our privacy policy.
Third Party Rights: Except for our affiliates, directors, employees or representatives, a person who is not a party to this agreement has no right to enforce any term of this agreement, but this does not affect any right or remedy of a third party that exists.
Laws of Spain: Each and every transaction carried out is deemed to be completed within Spain (and therefore shall be governed by and interpreted in accordance with Spanish Law). The terms of this contract (and any dispute, controversy, proceedings or claims of whatever nature in relation to them) shall be governed and interpreted in accordance with Spanish law and the Spanish Courts shall have exclusive jurisdiction in relation thereto.
Entire Agreement: These terms and conditions, together with our current website prices, delivery details, contact details and privacy policy, set out the whole of our agreement relating to the supply of the goods to you by us. Nothing said by any salesperson on our behalf should be understood as a variation of these terms and conditions or as an authorized representation about the nature or quality of any goods offered for sale by us. Save for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading. We make no representations or warranties about the accuracy completeness or suitability for any purpose of the information and related graphics published on our website. From time to time our site may contain technical inaccuracies or typographical errors. All liability of Budwig howsoever arising for any such inaccuracies or errors is expressly excluded to the fullest extent permitted by law. Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you may have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.
Trade Marks: All trademarks, product names and company names or logos sited herein are the property of their respective owners. No permission is given by Budwig in respect of the use of any such brand names, product names or titles or copyrights and such use may constitute an infringement of the owners’ rights.
